Trade TermsA. Conclusion of the contract1. The conclusion of the contract is preceded by the Client submitting a request for quotation (hereinafter "RFQ"). The request may be submitted in writing directly at the Rapid Crafting (Materia Sp z o.o.) office, by post, or by email. The request may also be submitted by email or telephone.
2. The received inquiry is thoroughly analyzed, particularly in terms of its technical feasibility, as well as in terms of applying the most favorable technical and financial terms. After reviewing the inquiry, Rapid Crafting (Materia Sp z o.o.) prepares an offer (hereinafter referred to as the offer) and sends it to the Client via email. The offer's validity period is specified in the offer.
3. The contract (hereinafter referred to as the order) is concluded on the date the Customer places an order based on the received offer. Placing an order containing any terms different from those presented in the offer or inquiry, or any additional circumstances, will be treated as submitting a new inquiry and will not be processed.
4. Orders can be placed in any form, in particular any of the forms appropriate for submitting an inquiry or by email. If an order is placed in a form other than written or email, Rapid Crafting (Materia Sp. z o.o.) may withhold processing until it is confirmed in writing. For orders exceeding PLN 5,000, orders must be placed in writing. For orders exceeding PLN 1,000 in total, Rapid Crafting (Materia Sp. z o.o.) charges a deposit of 30% of the order value. Orders can only be placed or confirmed by authorized representatives of the Customer, and they must provide appropriate documentation. Upon Rapid Crafting (Materia Sp. z o.o.)'s request, the Customer must submit the original of such a document or an officially certified copy.
5. Placing an order means:
I) confirmation that the circumstances indicated in the inquiry are the only circumstances accompanying the execution of the order, II) the Client has the financial resources necessary to pay the remuneration due to Rapid Crafting (Materia Sp z o.o.), III) acceptance of all terms and conditions presented in the offer, in particular the production technology, quantity, price, completion date, delivery terms, payment terms, etc., IV) acceptance of these Terms and Conditions.
6. The Order execution deadline is counted from the day following the date of placing the order or its confirmation, in the cases specified in point A.4 of the Terms and Conditions.
B. Design work1. The principles set forth in point A apply accordingly to contracts involving the performance of design work by Rapid Crafting (Materia Sp z o.o.), with the following caveats: Unless the offer specifies otherwise, the scope of design work includes the creation of 3D digital models in accordance with the requirements submitted by the Customer. Any changes to requirements after an order has been placed will be treated as submitting a new Inquiry, and the contract concluded on the basis of the previous Inquiry will expire. The costs of fulfilling such an order will be charged to the new order.
2. Design work is completed by Rapid Crafting (Materia Sp z o.o.) presenting a 3D digital model. Once completed, it is forwarded to the Client for approval. If the Client approves the 3D model (in writing or verbally), design work is considered complete and the order fulfilled. Additional design work after the Client approves the 3D model will be carried out under a separate order.
3. 3D CAD digital models submitted for printing are not modified by Rapid Crafting (Materia Sp z o.o.). Rapid Crafting (Materia Sp z o.o.) is not responsible for errors in the construction of the CAD model submitted for printing, which may affect the durability or strength of the model.
C. Disclaimers1. Products manufactured by Rapid Crafting (Materia Sp z o.o.) using specific manufacturing technologies possess the inherent shape, dimensional, and surface accuracy typical of these technologies. Information on the scope of application of each technology, as well as shape, dimensional, and surface accuracy, is available on the website www.rapidcrafting.com and on the websites of the manufacturers of prototype machines used by Rapid Crafting (Materia Sp z o.o.).
2. The selection of manufacturing technology is made by the Client with an understanding of its scope of application, accuracy of dimensional and shape reproduction, and surface condition. Imperfections in shape, size, and surface condition characteristic of individual prototype technologies do not constitute grounds for complaint.
3. Due to their limitations, some prototype technologies cannot reproduce the details (elements below 0.1mm) of a digital model. Failure to reproduce such details is typical of prototype technologies and does not constitute grounds for complaint.
4. The materials used to produce prototype parts are specialized materials with unique physical, chemical, and strength properties. Material data sheets are available on the websites of prototype machine manufacturers or, upon request, will be made available by Rapid Crafting (Materia Sp. z o.o.). The Client is responsible for selecting the material/technology.
5. For technological reasons, parts manufactured using prototype technologies may be manufactured in their entirety or in parts, which are then joined together using the joining technology specified for the given prototype technology. Unless otherwise specified in the commercial offer, the fact of manufacturing a combined model does not constitute grounds for filing a complaint.
6. Objections to the Subject of the Order resulting from the circumstances presented in points 1-5 above cannot constitute grounds for a Complaint.
D. Responsibility1. Rapid Crafting (Materia Sp z o.o.)'s liability for non-performance or improper performance of the Order is limited to actual damages (with the complete exclusion of any indirect damages, including lost profits) and to an amount not exceeding the remuneration paid for the product. Rapid Crafting (Materia Sp z o.o.) shall not be liable for the use of the Subject of the Order, in particular its use for illegal purposes, even if the content of the Order leaves no doubt as to the Customer's intention to use it. They reserve the right to notify the appropriate authorities of any such case.
E. Additional services1. In connection with the execution of orders, in accordance with the provisions of points A and B, Rapid Crafting (Materia Sp z o.o.) may provide the Customer with additional services (hereinafter referred to as the Service), in particular varnishing of the coatings of the manufactured elements.
2. Services are provided for a fee at the express request of the Client expressed in the inquiry, under the conditions resulting from the accepted offer.
3. Rapid Crafting (Materia Sp z o.o.) does not guarantee that the performance of additional services will achieve the expected result, particularly when it involves painting (covering models with varnish coatings). Rapid Crafting (Materia Sp z o.o.) is not liable in this respect.
4. Reservations regarding additional services cannot constitute grounds for filing a complaint.
F. Reception1. The subject of the order or the project (point B) is delivered by Rapid (Materia Sp z o.o.) by courier (hereinafter referred to as the shipment), at the expense and risk of the Customer, unless the approved offer states otherwise.
2. Upon receiving the shipment, the customer is authorized to open the shipment and verify the condition of the delivered item before signing the delivery receipt. Signing the delivery receipt constitutes confirmation that the order has been properly fulfilled and releases Rapid Crafting (Materia Sp z o.o.) from any liability for the condition of the delivered item.
3. Any complaints regarding quality or quantity (hereinafter referred to as complaints) must be submitted in writing within one day of receipt of the shipment. Failure to notify of any complaints within this timeframe will constitute acceptance of the order without reservation.
4. Submitting a complaint does not justify the refusal or suspension of payments to Rapid Crafting (Materia Sp z o.o.). A complaint filed by a Customer who is in arrears with payment will not be considered.
5. Refusal to accept the sent shipment and its return to Rapid Crafting (Materia Sp z o.o.) will result in the obligation to pay Rapid Crafting (Materia Sp z o.o.) a contractual penalty in the amount of the product of the commenced days of storage of the shipment at Rapid Crafting (Materia Sp z o.o.) and the rate for each day, constituting 0.01% of the order value.
G. Payments1. Confirmation of the offer constitutes an unconditional commitment, in particular to pay for the order within the time specified in the order. Complaints or other objections, particularly regarding the content of the invoice, do not constitute grounds for refusal of payment.
2. Delay in payment entitles Rapid Crafting (Materia Sp z o.o.) to charge statutory interest on any outstanding payments and to issue interest notes.
3. In the event of a delay in payment exceeding 30 days, Rapid Crafting (Materia Sp z o.o.) will be entitled to refer the case to the competent court and charge the Client with an additional cost in the amount of 8% of the remuneration, which will be claimed together with the remuneration amount.
H. Final provisions1. By placing an order, the Customer declares that: I) he/she has read the Terms and Conditions and understood their content to the extent necessary to consciously complete the order and II) he/she has sufficient financial resources to fulfill his/her obligations towards Rapid Crafting (Materia Sp z o.o.) arising from the order.
2. In matters not regulated, the provisions of Polish law, in particular the Civil Code, shall apply.
3. The assignment of receivables arising from this contract requires the consent of the other party, except in the case of the assignment of receivables due to Rapid Crafting (Materia Sp z o.o.) for the performance of the order, which have not been settled on time.
4. The offsetting of Rapid Crafting's (Materia Sp z o.o.) receivables arising from the order may only be offset against receivables recognized by Rapid Crafting (Materia Sp z o.o.) or confirmed by a final judgment of a common court.
5. Any disputes arising in connection with the execution of orders will be resolved by common courts in Warsaw.
6. These provisions do not apply to contracts concluded with consumers within the meaning of separate provisions.
7. Rapid Crafting (Materia Sp z o.o.) reserves the right to change these terms and conditions at any time without justification. Orders not completed by the date of the changes will be fulfilled according to the existing terms and conditions.
8. The terms and conditions come into effect on March 1, 2025.
Information on technology and materials: Deviations from nominal dimensions are unavoidable in the production of plastic components. Dimensional deviations due to production are due to many factors, including: processing disturbances related to: • uniformity of the molded mass • machine settings • tool temperature • tool deformation under pressure.

- the right to erase your data or restrict data processing;

7. Source of dataThe Data Controller obtained your personal data by voluntarily providing it via email when contacting Rapid Crafting, by finding it online, from advertisements in trade magazines, from telephone directories, and from databases. - You have the right to access your data and the right to rectify, erase, restrict processing, the right to data portability, the right to object, and the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal. - You have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that the processing of your personal data violates the provisions of the GDPR.
